Decree no94-2137 of 10 October 1994
 
 
This decree refers to the organisation and the terms and conditions under which the Centre for Arab and Mediterranean music in the Baron d’Erlanger Palace, Sidi Bou Said, will operate, published in the Official Gazette of the Tunisian Republic on 10 October 1994. It provides as follows.
 
The President of the Republic, upon proposal from the Minister of culture:
 
- Considering law no73-81 of 31 December 1973 enacting the public accounting code and all the laws modifying or completing it,
- Considering law no83-112 of 12 December 1983 bearing on the general status of public servants, local government authorities and public administrative bodies,
- Considering law no92-122 of 29 December 1992 on the finance law for 1993 administration and in particular its article 63.
- Considering law no93-85 of 2nd August 1993 modifying the press code
- Considering decree no85-261 of15 February 1985 defining the categories to which the different ranks of civil servants, local public authorities and public bodies of an administrative nature belong
- Considering decree no88-188 of 11 February 1988 regulating the conditions governing the appointment and the rescinding of the civil service positions of Secretary general of a ministry, director general of central administration, director of central administration, deputy-director of central administration, department head of central administration.
- Considering decree no89-1989 relative to government contracts such as modified by decree no90-557 of 30 March 1990.
- Considering decree no93-2378 of 1993, on the organisation of the ministry of culture.
- Considering the opinion of the minister of finance
- Considering the opinion of the administrative tribunal.
 
Decrees:

CHAPTER ONE : GENERAL PROVISIONS
 
 Article one – The centre for Arab and Mediterranean music is a public administrative body with a legal personality and financial autonomy.
It is placed under the responsibility of the Ministry of Culture.

 Article 2 – The headquarters of the Centre of Arab and Mediterranean Music are established at Sidi Bou Said.
 
 Article 3 – The centre for Arab and Mediterranean music is an establishment in the form of a multidisciplinary cultural complex devoted to music in its different domains. Adopting a global and integrated vision, it combines scientific and intellectual activities and the programming of musical events. Amongst its centres of interest are musical heritage and contemporary musical creation in Tunisia, in the Arab world and in the countries around the Mediterranean.
 
Its particular areas of responsibility are :
 
- preservation of musical heritage
- promotion of musical studies and research 
- managing the   “Ennejma Ezzahra” palace  as a venue for cultural activities within the context of  a historical architectural monument,
- preparation of programmes of an artistic and intellectual nature in the different fields of music,
- Researching   musical heritage, carrying out and disseminating research or studies in this respect. 
- ensuring the collection and conservation of musical instruments and preparing studies in this respect,
- endeavouring to develop the holdings of the National Sound Archive through the collection of recordings of Arab, Mediterranean and other music.
- dissemination of studies and research on music
- endeavouring to crystallize the  complementarity between music and other artistic expressions.
- supervision of the legal deposit of audio recordings.


CHAPTER II : Administrative organisation.
 
 Article 4 – The centre consists of :
- The Director,
- The Executive committee
- The Secretary General
- The Deputy Director of the National Sound Archive.
 
 Article 5 – The centre is headed by a director appointed by decree at the suggestion  of the minister of culture  from amongst the  duly qualified candidates  for the post of director of  a central administration in conformity with the provisions of the aforesaid decree  no88-188 of 11 February 1988.
 
 Article 6 – The director of the centre holds the following administrative responsibilities:
- drawing up the centre’s cultural programmes for submission to the Executive Committee,
- designing the centre’s general  policy in the areas of scientific research, conservation and protection, cultural and musical activities,
- managing the centre’s  administrative, financial and technical affairs including coordination between different departments,
- representing the centre in  civil, administrative and legal processes in conformity with the laws and prerogatives assigned to it.
- preparing and following-up the Executive Committee’s decisions,
- executing acts, contracts and agreements entered into on behalf of the centre
 
 Article 7 – the Executive committee pronounces itself on the following issues:
- The centre’s general policy in all areas
- The centre’s overall draft budget
- The centre’s cultural programmes
- The evaluation of the performance as well as the activities of the centre’s various structures
- An annual performance report is submitted to the governing authority
 
 Article 8 - The Executive committee, chaired by the director of the centre, is composed of the following members:
 
- The secretary general
- The deputy-director of the National Sound Archive
- The centre’s department heads
- Two personalities from the cultural sphere appointed by the minister of culture.
 
The centre’s secretary general is in charge of the Executive Committee’s secretariat. The president of the Committee may call upon anyone whose presence is deemed necessary to the work of the board.
The members of the Executive Committee are appointed by order of the minister of culture.
 
 Article 9 – the Executive Committee meets at least once every three months and each time the president deems it necessary.
The Executive Committee’s decisions are taken by majority vote of members present. In case of a tie-vote, the President has the deciding vote.
The committee’s deliberations are recorded in the minutes that are transmitted to the minister of culture and to the members of the committee within fifteen days from the date of the committee meeting.
 
 Article 10 – The Secretary General is responsible for assisting the director of the centre in the management of the administrative and financial services.
The Secretary General is appointed by decree at  the suggestion of the  minister of culture from amongst the duly qualified persons for the position of deputy director of a central administration  in conformity with the aforesaid decree no88-188 of 11 February.
 
 Article 11 – The General secretariat is made up of :
a) the administrative and financial department in charge of:
- managing the centre’s human resources,
- preparing regulations relative to the centre’s staff
- drafting and presenting the centre’s running and capital budgets
- preparing and incurring the centre’s expenses, committing credits and keeping the books in this respect.
 
b)the technical department is  in charge of:
- preparing and carrying out research and architectural studies and restoration plans for the palace buildings and the ancillary administrative buildings.
- maintaining the centre’s technical facilities,
- designing landscaping improvement projects for the palace gardens
- overseeing the running and the maintenance of the audio-visual equipment used for the centre’s cultural activities programmes
- providing technical support for events organized on the centre’s premises ,
- overseeing the general maintenance of the centre,
- managing the fleet of cars
- keeping the related accounts for the centre.
 
 Article 12 – The Department of the National Sound Archive is responsible for:
- Supervising the legal deposit of audio recordings.
- Collecting musical recordings in all types of format to conserve them and make them available to music researchers.
- Provide for the collection, documenting and the dissemination of musical heritage,
- Ensure the protection of musical heritage
- Ensure the conservation of audio-visual documents of whatever format.
 
 Article 13 – The Department of The National Sound Archive consists of two sections:
- The research and studies section
- The programming and cultural activities section .
 
 Article 14 – The deputy director and heads of department are appointed by decree at the minister of culture’s suggestion from amongst those duly qualified to hold the position of deputy-director in a central administration  and department head in a central administration in conformity with the provisions of the aforesaid decree no88-188 of 11 February 1988.


CHAPTER III : Financial organisation
 
 Article 15 – The director of the centre draws up an annual draft budget that is submitted to the minister of culture.
 
 Article 16 – The centre’s budget includes expected income and expenditure relative to ordinary operations.
 
 Article 17 – The centre for Arab and Mediterranean music’s income is secured from the following resources:
- State subsidy
- Income earned by the Centre
- Earnings from the sale of publications published by the centre,
- Donations and legacies
- Any other income given to the centre.
 
 Article 18 – The centre’s expenditure is broken-down as follows:
- The centre’s operational expenses
- Maintenance and restoration expenses
- Expenses relative to research and studies
- Expenses relative to the cultural events programme
- Any unforeseen expense linked to the centre’s activities.
 
 Article 19 – The ministers of finance and culture are each responsible for the implementation of the present decree that will be published in the Official Gazette of the Tunisian Republic.
